(53) S.C.No.463/2009 (Judgment) arrested Javed at 3.30 hours on 22.6.2009. His evidence also discloses that on 22.6.2009 at 2.30 hours by night, he interrogated to accused Jawed, who also admitted that he had given said mobile phone to Pradip Chandaliya. Therefore, he arrested accused Pradip at 3.30 hours by night. It also appears that on 22.6.2009, P.I. Shri Borse had also arrested accused Ram Bodkhe by preparing arrest panchnama. It seems that on 30.6.2009 he sent accused Jawed for medical examination. It also appears that on 22.6.2009 he produced accused Jawed before concerned J.M.F.C and he got extended his Police Custody from the concerned J.M.F.C for 14 days. Therefore, it is ample clear that since 22.6.2009 accused Jawed was in Police custody. 90/­ The evidence of P.I. Shri Borse, also discloses that on 23.6.2009 he interrogated towards accused Jawed about his clothes which were on his person at the time of incident. It seems that accused showed readiness to produce those clothes and hence he called two panchas. His evidence further shows that, then accused gave statement before him and panchas that he had hidden those clothes below the heap of garbage which was in front of said building in question i.e. Purva
