Hence Shri Borse reduced his statement into writing (Exh­61) and he obtained the signatures of panchas and that of accused and thumb mark of accused below it. He also signed it. 91/­ His evidence further discloses that then after accused Jawed led them to the spot in question i.e. opposite to Purva Apartment where the incident took place. The evidence of I.O further discloses that near Purva Apartment, accused Jawed asked to stop the vehicle and then accused got down and they also got down. Then accused had gone near the heap of waste articles which was there and he took out carbon coloured Jeans pant of Spaykar Company and one green coloured T shirt on which “Western Country Jamboree” was written. Accused Jawed Khan produced those clothes before P.I. Borse and panchas and at that time, P.I.Borse noticed blood stains on the front side portion of that T­ shirt. Therefore, those clothes (Article­27 & 28) were seized by P.I.Borse on the spot itself under panchnama at Exh­62. 92/­ Therefore, the evidence of P.I.Borse categorically discloses that at the instance of accused Jawed he had recovered those clothes i.e. T shirt (Article­28) and Jeans Pant (Article­27) of accused Jawed which were on his person at the time
