Carbon copy G.D. 20. dated PW-13 Constable Clerk Exhibit Riyazudeen Khan Ka-17 PW-13 Khan Riyazudeen Exhibit Ka-18 Upon completion of the oral as well as documentary evidence, the statement of the accused was recorded under Section 313 of the CrPC in which, the accused stated that he was innocent and had been falsely implicated in the alleged crime. 21. The trial court upon appreciation of the oral as well as the documentary evidence on record, arrived at the finding that the prosecution had been successful in establishing its case against the appellant-convict beyond reasonable doubt. Accordingly, the trial court held the appellantconvict guilty of the offence enumerated above and sentenced him to death. 22. The appellant-convict being dissatisfied with the judgment and order passed by the trial court, challenged the same before the High Court. The High Court dismissed the appeal of the appellant-convict and confirmed the death sentence imposed by the trial court. 23. In such circumstances referred to above, the appellant-convict is here before this Court with the present appeals. 9
