(36) S.C.No.463/2009 (Judgment) No.1 by name Jawed is the author of said crime. 65/­ Prosecution also examined panch witnesses by name Mukram Khan s/o Abdul Gaffar Khan, Hidyat Khan s/o Feroz Khan, Afroz Khan s/o Feroz Khan, and Asif s/o Mohammad Akbar before whom the clothes of accused Jawed, that of Aniket and gold ring of Aniket were seized. Basically these witnesses did not support the prosecution on some points and on some points they have supported. But the cross examination of these witnesses conducted on behalf of accused needs to be decided while scrutinizing their evidence. 66/­ The prosecution also examined the Naib Tahsildar and panch witness on the identification parade of the clothes of Aniket and his gold ring. However, in the light of the cross examination of these witnesses, it seems that the presence of Police was there and one identification parade was conducted at Police Station. Hence I am of the opinion that no much weightage needs to be given to these witnesses on identification parade. It need not be considered.
