(40) S.C.No.463/2009 (Judgment) First part:­ it consists of the evidence of first 10 witnesses including the evidence of Dr. Mugdalimath and Dr. Gadge. Second part:­ It consists of the evidence of P.C.Ravindra Bahule & API Shri Gautam Patare (Exh­74 & 75). Third part:­ It consists of the evidence of Panch witnesses and I.O. Shri Borse on the memorandum ­ discovery panchnamas. Panchas on discovery have not fully supported. But on the some points, they support and on some points they did not support. Hence evidence of I.O. Shri Borse needs to be considered. Fourth part:­ It consists of the evidence of Medical Officers Dr. Hina Khan, Dr. Mugdalimath, Dr. Gadge and C.A.reports & D.N.A. Test reports. This evidence is being that of experts, is rather more important. It is to be read along with the evidence of I.O Shri Borse, who seized the muddemal. Also it consists of two Medical Officers who conducted post mortem. Said evidence discloses the fact that the culprit had entered into the house of informant and Mansi in order to commit theft and committed theft of mobile of Mansi, gold ring of the informant and his clothes along with cash of Rs.450/­.
