69 Cri.Appeals 516, 281 n 468 of 2012.odt rt Constitution Bench of the Hon'ble Supreme Court time and again it appears to us that for deciding just and appropriate sentence to C ou be awarded for an offence aggravating and mitigating factors and circumstances in which crime has been committed are to be delicately balanced in a dispassionate manner. We now propose to deal with aggravating and mitigating circumstances in the AGGRAVATING CIRCUMSTANCES : a) H 85. ig h present case. The offence committed by Accused No.1 Jawedkhan ba y had not been committed on the spur of moment. It was preplanned. Accused No.1 entered the house to commit theft but did not stop there and in order to om satisfy his lust forcibly raped a young defenceless lone girl and then eliminated her life in a beastly, brutal and barbaric manner. We consider this grisly and a B gory episode as an ultimate insult to the humanity in general and womanhood in particular. b) Subsequent conduct of accused indicates that he had felt no remorse. c) Neither the victim nor her family members had any animosity with the accused. ::: Uploaded on - 08/03/2016 ::: Downloaded on - 13/03/2016 19:36:29 :::
