Case Background (300 words max): On June 22, 2017, at approximately 4:55 a.m., domestic worker Mo Huanjing deliberately used a lighter to ignite a book, which subsequently set fire to flammable items in her employer Zhu Xiaozhen’s living room, including the sofa and curtains. The fire spread rapidly, resulting in the death of Zhu and her three minor children, and significant damage to the residence and neighboring properties. Mo was charged with arson, punishable by the death penalty. During the first-instance trial, defense counsel alleged obstruction by the investigative authorities in accessing evidence. The defence lawyer repeatedly contested the court’s jurisdiction, requesting the case be transferred to a court outside the area of the incident. The court revoked his representation due to his withdrawal from the proceedings in protest, and appointed local legal aid lawyers to take over the defence, raising serious concerns about Mo’s right to a fair trial. The victims’ family waived claims for civil compensation, instead demanding the harshest criminal penalty. The family garnered widespread public sympathy through persistent appeals on social media. Meanwhile, Mo’s history of theft and gambling, sparking extensive public discourse about her character. As a nationwide focal point, the case subjected the judicial authorities to intense public pressure. The defence focuses include whether Mo had the intent to commit arson and to cause the resulting grave consequences, as well as whether the property management and firefighting services bore any responsibility. Both the first-instance court and appellate court found that Mo intentionally committed arson with knowledge of its severe potential consequences. The Supreme People’s Court upheld these rulings, and eventually approved the imposition of the death penalty. On the morning of September 21, 2018, Mo Huanjing was executed by lethal injection following the Supreme People’s Court’s final approval of the death sentence.

Defence Arguments (200 words max.)

First-Instance Defense Arguments:

The defendant lacked intent to commit arson, intending only to start a small fire and extinguish it to borrow money from her employer.
She only ignited a book and did not intentionally set fire to the curtains or sofa, nor did she intend to cause a fire, deaths, or significant property damage.
After the fire broke out, she actively attempted to extinguish it and did not flee the scene.
Inadequate property management and delayed firefighting efforts contributed to the severe consequences.
She confessed truthfully after her arrest, constituting a mitigating factor warranting leniency. Second-Instance Defense Arguments:
The defendant lacked subjective intent for arson and opposed the grave consequences, characterizing her actions as negligence.
She attempted to extinguish the fire and rescue victims.
Deficiencies in property management and firefighting equipment were causally linked to the severity of the consequences, and the evidence shows the fire department failed to receive timely information about trapped victims. These factors should be considered in sentencing.
Her confession constitutes voluntary surrender.
The sentence was overly harsh; her malice and danger to society were minimal. The first-instance court failed to properly consider mitigating factors and applied a sentence inconsistent with judicial practice for arson. Leniency in sentencing and cautious application of the death penalty were requested. SPC Defense Arguments:
While the defendant intentionally started the fire, the severe consequences resulted from negligence, not deliberate intent, and thus the maximum penalty should not apply.
The defendant’s malice is less severe than cases involving both intent to commit arson and intent to cause serious consequences, making the death penalty disproportionate.
She attempted to extinguish the fire and rescue victims, though unsuccessfully, and these actions were unfairly dismissed in prior rulings.
She called for help, awaited arrest, and confessed truthfully, qualifying as voluntary surrender and warranting leniency.
Property management and firefighting deficiencies were linked to delays in extinguishing the fire, which should be considered in mitigating the sentence.
Precedents in similar cases with severe consequences do not mandate the death penalty, and this case fails to meet the “uniqueness” and “exclusivity” standards required for capital punishment.

Judgement with Headnotes (200 words max)

First-Instance Court Ruling:

Mo Huanjing deliberately committed arson in a high-rise building, causing four deaths and significant property damage, constituting the crime of arson.
The court found her motives despicable, the consequences severe, and the impact harmful to public safety.
Her confession to arson was acknowledged but insufficient to merit leniency. Therefore, the death penalty was imposed for the arson charge. Second-Instance Court Ruling:
Mo had premeditated the arson, supported by evidence of her online searches about fires before the incident.
Mo lacked intent to stop the fire;
Mo failed to prevent the resulting severe consequences.
Her confession did not qualify as voluntary surrender.
The appellate court reaffirmed that the severe consequences, including the deaths, were solely caused by Mo’s actions. Property management deficiencies were linked to delayed firefighting but were unrelated to the victims' deaths. Therefore, the death penalty was upheld based on the severity of her actions and their social harm. Supreme People’s Court Review Ruling:
The SPC confirmed Mo’s premeditation, evidenced by her planning to use the fire as a ruse to gain sympathy for financial gain.
Her arson directly caused the deaths of four victims and significant property damage. The Supreme Court did not substantially consider property management issues, such as low water pressure, or the delayed firefighting efforts. Mo’s confession was not taken into account as mitigation factors. Therefore, the death penalty was upheld due to the gravity of the offence, Mo’s malicious intent, and significant public harm.
