案件背景 (最多300字): Muhammad Nur Ismail alias Malik Bin Ismail is an Indonesian citizen who was arrested by members of the Police on December 12, 2008 after carrying out a marijuana buying and selling transaction in which the marijuana was to be transported from Banda Aceh to be sent to the Cikampek area. The defendant was sentenced to life imprisonment in the court of first instance, while at the appeal level he was sentenced to 20 years in prison, and life imprisonment.

辯方意見 (最多200字): In the process of filing a judicial review, Muhammad Nur Ismail's legal counsel alleged claims of torture committed by investigators during the interrogation, and that Muhammad Nur Ismail was not accompanied by legal counsel. Every time Muhammad Nur Ismail answered the investigator's questions with responses that did not align with the investigator's expectations, the investigator in question would immediately strike Muhammad Nur Ismail’s body with his hands and a large black electrical cable. This repeated action occurred every time Muhammad Nur Ismail was interrogated by the investigator, until Muhammad Nur Ismail surrendered and was forced to follow the investigator’s will because he could not bear and endure the suffering.

判决摘要 (最多200字): The defendant submitted a second PK application but none of them were accepted by the panel of judges on the grounds that they did not meet the formal requirements. This is because there is a Supreme Court Circular Letter (SEMA) Number 7 of 2014 concerning the Submission of Applications for Review in Criminal Cases which limits the application for review which can only be submitted once even though the previous Constitutional Court Decision Number 34/PUU-XI/2013 previously allowed the submission of a review application more than once. In fact, the Supreme Court Circular Letter (SEMA) Number 10 of 2009 concerning the Submission of Review mandates all district courts not to forward the submission of the second or more PK application file of the convict to the Supreme Court.
