案件背景 (最多300字): MGS. Zainal Abidin bin MGS. Mahmud Badaruddin is an Indonesian citizen who was arrested by the Police for buying and selling marijuana in December 2000. Initially, the defendant bought 3 sacks of marijuana weighing 58.7 kilograms, then he sold it back to several people, but the defendant's actions were eventually known by members of the Police. This case reaped irregularities because at the appeal and cassation level trials, the defendant was sentenced to death accompanied by a fine of Rp 5,000,000.00 (five million rupiah). However, in the end, the panel of judges at the judicial review level annulled the verdict by eliminating the criminal fine because the defendant had been sentenced to death.

辯方意見 (最多200字): Zainal's legal counsel, during the first-instance trial, defended against the public prosecutor's charges by arguing that the prosecutor disregarded the presumption of innocence. In the indictment, Zainal was imperatively accused of "selling and buying marijuana," even though this was not mentioned in any identification. The counsel also argued that the prosecutor's indictment was vague and imprecise, tending to be a form of fabrication and manipulation. Furthermore, the prosecutor did not specify in detail when, where, and how Zainal ordered and purchased the marijuana. At the cassation stage, Zainal's legal counsel presented claims of torture, stating, "Even during the defendant's examination, the defendant denied the Examination Report (BAP), asserting that it was merely a fabrication. This was because, when the BAP was made on December 21, 2000, the defendant had already been beaten and intimidated by investigators to prevent physical marks, which led the defendant to fabricate the story."

判决摘要 (最多200字): On the claim that there was coercion in the Examination Report (BAP) experienced by the defendant, the panel of judges did not accept the claim of torture because the investigator testified that he did not coerce the defendant in obtaining information.
