(41) S.C.No.463/2009 (Judgment) Baburao Patade, Shantabai Soni, Manoj Mali, Aniket Deshpande, Shobhana Patil and Sindhu Gore shows that the household articles were lying scattered in the house of Mansi and Aniket and the supplementary statement given by Aniket shows that the culprit had committed theft of his gold ring, mobile phone of Mansi and clothes of informant and cash amount. 75/­ The evidence of Medical Officer Dr. Mudalimath and Dr. Ghadge categorically discloses as to how Mansi was murdered and at the same time it also discloses that Mansi was raped. The P.M.Report is not disputed on behalf of accused No.1 by name Jawed. Therefore, in the light of said P.M.Report, it can be inferred that Mansi was raped and she was murdered and hence the death of Mansi is homicidal one. 76/­ The evidence of informant by name Aniket Deshpande discloses that the mobile of Mansi and his gold ring & clothes were stolen from the house. It is not disputed that at the time of filing FIR, he might be aware of that fact. However, in the FIR he has not stated that said mobile phone, his clothes and his gold ring as well as cash of Rs.450/­ were stolen. It seems that at the time of giving supplementary statement he has disclosed that fact.
