"The case against the accused was that he had allegedly committed the rape and murder of two minor girls.
The circumstances against the accused are, an extrajudicial confession; recovery (of victim’s bodies and clothes) based on directions given by the accused; chemical analysis that showed a match in the blood found on the accused’s clothes and nails and that of the victims.
The trial court sentenced the accused to death, which was confirmed by the High Court and the Supreme Court in its criminal appeal and in a review petition decision dated on 16.05.2008. In an appeal for the reopening of the review petition filed against the SC’s confirmation, the court partially allowed the appeal and commuted the sentence to life imprisonment.
This judgement is significant because it clarified Indian death penalty jurisprudence on the consideration of the question of mental illness which developed post conviction.
- 辯方意見 (最多200字)
The defence did not raise any arguments on the merits of the case, but raised two arguments on procedural infirmities.
- The Trial Court had not given the Petitioner a separate hearing while awarding the sentence, in contravention of a statutory provision that provides for the right of pre-sentence hearing
- The award of death sentence was contrary to the Court’s holding in a prior case, which held that the execution of persons suffering from mental illness or insanity violates the fundamental right to life and liberty under the Constitution, and that such mental illness or insanity would be a supervening circumstance meriting commutation of the death sentence to life imprisonment.
- 判决摘要 (最多200字)
Sentencing: 1)The aggravating circumstances of the crime, i.e. the magnitude and manner of commission of the crime in the form of the kidnapping, rape and murder of two minor girls, outweighed the mitigating circumstances of the accused, i.e. the dependency of his aged mother on him, and his young age. 2) Gave weightage to the prior convictions of the Accused for the same kind of offence, i.e. for the offence of rape of a nine-year-old girl. Fair trial: Held that the accused had been given opportunities to represent himself and produce evidence at all stages of the trial, and provide documents regarding his mitigating circumstances. Post-conviction mental health:
- Given that the Accused had been a death-row convict for almost 17 years, the court held that henceforth, post-conviction severe mental illness would be a mitigating factor for commuting the death sentence.
- The Court laid down a ‘test of severity’ which posits that the mental illness should be so severe such that the prisoner is unable to “understand or comprehend the nature and purpose behind the imposition of such punishment”. Privacy: The Court upheld the right to privacy of the accused as under the Mental Healthcare Act, and chose to not disclose his real name and other identifying information.
